Options

The Framework is being procured as an Open Framework in accordance with the Procurement Act 2023 and will have a maximum duration of eight (8) years. The Authority intends to reopen the Framework annually throughout this period to allow new Suppliers to apply for appointment. The initial Framework scheme (Scheme 1) is expected to commence in January 2027 and will be awarded for an initial period of 12 months. The Authority may extend Scheme 1 by up to two further periods of 12 months. The Framework is intended to reopen annually thereafter, with Scheme 2 expected to commence in January 2028, Scheme 3 in January 2029, Scheme 4 in January 2030, Scheme 5 in January 2031, Scheme 6 in January 2032, Scheme 7 in January 2033 and Scheme 8 in January 2034. Schemes 2 to 6 will each be awarded for an initial period of 12 months, with the option for the Authority to extend each scheme by up to two further periods of 12 months. Scheme 7 will be awarded for an initial period of 12 months with the option to extend by up to one further period of 12 months. Scheme 8 will be awarded for a period of 12 months with no extension option.

Contracts may be awarded to successful suppliers with a place on the framework either with or without competition, in compliance with PA23. Any contracts under the framework awarded without competition will be awarded according to mechanisms detailed in the associated tender documents. The Customer is required to award any Call-Off Contract in accordance with the competitive selection process unless the Customer can determine that any of the following apply: a. the estimated value of its Statement of Requirements is below the relevant Procurement Thresholds; b. the Services to which the proposed Call-Off Contract relate are capable of being provided only by the existing Supplier due to an absence of competition, either as a result of the technical nature of the Services or the particular Supplier having the intellectual property rights, and there are no reasonable alternatives to the Services; c. the Services to which the proposed Call-Off Contract relate are intended as an extension to, or replacement of, existing Services in circumstances where a change in supplier would result in the Customer receiving Services that are different from or incompatible with the existing Services, and the difference or incompatibility would result in disproportionate technical difficulties in operation or maintenance; and then the Customer may award a Call-Off Contract without a competitive process.
