This note formally records that the Transparency Notice was not published at the required stage of the process, due to a procedural oversight. Once identified, the issue was promptly escalated and corrective action was taken to ensure a notice is completed and published in line with the relevant regulatory and governance requirements. Internal processes and controls have since been reviewed to reduce the risk of this happening again. This medicine is a NICE approved product which is not currently available for procurement under the Bleeding Disorders Framework, managed by NHS England. In order for Welsh patients to obtain access to this medicine while a contract is being negotiated between the supplier and NHS England, this contract is being direct awarded to SOBI.

The North East and Yorkshire NHS Pharmaceutical Purchasing Consortium intends to establish a framework agreement for the supply of Unlicensed Imported Medicines on behalf of NHS organisations and other eligible public sector bodies. The framework will provide access to a defined range of unlicensed imported medicines, including products requiring over-labelling and translation. These medicines do not hold a UK Marketing Authorisation but are licensed in their country of origin and may be imported and supplied in accordance with Regulation 167 of the Human Medicines Regulations 2012 where a patient's clinical needs cannot be met by a suitable licensed alternative. Suppliers will be required to hold all relevant MHRA licences, authorisations and approvals necessary to import, distribute and supply unlicensed medicines within the UK, and to demonstrate compliance with applicable Good Manufacturing Practice (GMP) and Good Distribution Practice (GDP) standards. The framework will provide participating organisations with access to safe, compliant and quality-assured products through a robust and competitive procurement arrangement. Products and suppliers will be subject to comprehensive quality, risk and commercial assessment to support regulatory compliance, supply chain resilience, continuity of patient care and value for money across the NHS.

The Counter CBRN Delivery Team, part of the UK Ministry of Defence (MOD), intends to award a contract to BBI Solutions for the continued manufacture and supply of the currently fielded Lateral Flow Devices (LFDs). The contract will be for a period of 4 years followed by two one-year option years. The value of the contract including the option years will be approximately £41M excluding VAT. The contract will provide continuity of supply whilst the Authority undertakes and completes a full open commercial competition for the longer-term provision of this capability. The LFDs form a critical component of the MOD's biological detection and identification capability and are employed to support operational readiness and defence outputs. Any interruption to the manufacture and supply of these devices would present a significant risk to capability availability, training activities, stock sustainment and operational preparedness. It is considered that the direct award of this interim contract is lawful in accordance with Section 41(1) of the Procurement Act 2023 and Schedule 5 for technical reasons. BBI is currently the sole organisation possessing the necessary technical knowledge, manufacturing processes, quality assurance arrangements, validated production methods, intellectual property, specialist reagents and approved supply chain required to produce the extant LFDs to the required specification. The existing LFD design, manufacturing process and associated technical data have been developed, qualified and proven through BBI's established production arrangements. Transitioning manufacture to an alternative supplier before completion of a competitive procurement activity would necessitate technology transfer, revalidation of manufacturing processes, qualification testing, quality assurance approvals and regulatory assurance activities. These activities cannot be completed within the timescales required to maintain uninterrupted supply. The Authority has determined that no reasonable alternative exists that could provide the required products in the necessary timeframe, quality standard and technical configuration without generating disproportionate technical, schedule and operational risk. Consequently, BBI is presently the only supplier capable of meeting the Authority's immediate requirement. This proposed direct award is intended solely as an interim measure to ensure continuity of supply and sustain operational capability until a full and open competition can be conducted. The Authority remains committed to undertaking a competitive procurement exercise to determine the longer-term provision of this requirement.

Suffolk County Council (Public Health, Communities and Public Safety) are currently out to tender for the postal supply of Nicotine Replacement Therapy (NRT) and smoking cessation prescription medication. Smoking prevalence in Suffolk is currently estimated at 10.5%. The Council's ambition is to reduce this to 5% or below by 2030. NRT and prescribed smoking cessation medications are recognised as effective interventions to support people to quit smoking and remain an important element of the local stop smoking offer. The Council currently provides access to these products through a pharmacy-based pathway. However, not all clients are able to access participating pharmacies due to factors such as working hours, limited transport options or mobility issues. The Council is therefore exploring alternative delivery models to improve accessibility. The procurement is split into two lots. Suppliers may bid for either lot individually or for both lots. Lot 1 - Nicotine Replacement Therapy (NRT) Supply a range of NRT products following referral from the Council's commissioned stop smoking service (FGS) and deliver products directly to clients using a reliable and secure postal service. Lot 2 - Smoking cessation prescription medication Undertake remote clinical consultations with clients referred by the stop smoking service to assess suitability for Varenicline or Cytisine and, where clinically appropriate, supply medication directly to clients using a reliable and secure postal service. This opportunity is available in the 'Current Tenders' area of the portal. Interested parties are invited to express their interest to gain full access to the tender documentation. The contract period is two years with an option to extend for up to a further two years. The anticipated contract value (including the extension period) is approximately £400,000 (approximately £100,000 per annum) excluding VAT. The deadline date for submissions of the tender is 3rd November 2026 at 11am. Please note late returns will NOT be permitted. The deadline for clarification questions is 20th October 2026 which must be generated via the correspondence option on the website.
